1. Acceptance of Terms
By downloading, installing, or using Airport Wind (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
2. Not for Flight Planning or Navigation
The App is for informational and educational purposes only.
Airport Wind is NOT a certified aviation weather product and must NOT be used for:
- Flight planning or dispatch
- In-flight navigation or decision-making
- Any operational aviation purpose
Weather data displayed in the App may be delayed, incomplete, inaccurate, or unavailable. Always obtain official weather briefings from approved sources (e.g., 1800wxbrief.com, official NOAA/FAA services) before any flight.
You assume all risk associated with any use of information provided by the App.
3. Data Sources and Accuracy
The App displays weather data from the NOAA Aviation Weather Center and airport diagrams from the FAA Aeronautical Information Services. These are public US government data sources. The developer does not control, guarantee, or warrant the accuracy, completeness, or timeliness of this data.
- METAR observations may be stale or unavailable for some airports.
- TAF forecasts are predictions and may not reflect actual conditions.
- Airport diagrams may be outdated between AIRAC cycle updates.
- Runway data from OurAirports is a community-maintained dataset and may contain errors.
- Crosswind calculations are mathematical estimates and do not account for local terrain, gusts variability, or other real-world factors.
4. Bundled Data
The App includes bundled airport and runway databases sourced from open data projects (mwgg/Airports and OurAirports). These are static snapshots and may not reflect the most current airport information.
5. In-App Purchases
The App offers an optional tip jar with consumable in-app purchases. These are voluntary contributions to support development. All purchases are processed by Apple through the App Store and are subject to Apple’s App Store Terms of Service.
- Tips are non-refundable through the App. Refund requests should be directed to Apple.
- Tips do not unlock any additional features or content.
- Prices are displayed in your local currency as determined by the App Store.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes what data is collected and how it is used.
7. Intellectual Property
- The App and its original code, design, and documentation are the property of SnickityBit Solutions LLC.
- Airport diagrams are produced by the FAA and are US government works in the public domain.
- Weather data is produced by NOAA and is US government data in the public domain.
- Airport data is sourced from open-source community datasets under their respective licenses.
- The Firebase SDK is the property of Google LLC.
8. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT:
- The App will be uninterrupted, error-free, or secure
- Weather data will be accurate, current, or complete
- Crosswind calculations will be correct for any given situation
- The App will be compatible with all devices or OS versions
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM:
- Your use of or inability to use the App
- Any reliance on weather data, crosswind calculations, or other information displayed by the App
- Any aviation incident or decision made based on information from the App
- Any unauthorized access to or alteration of your data
- Any interruption or cessation of service
10. Third-Party Services
The App relies on third-party services (NOAA, FAA, Google Firebase, Apple StoreKit) that are outside the developer’s control. The developer is not responsible for the availability, accuracy, or policies of these services.
11. Modifications
We reserve the right to modify these Terms at any time. Changes will be reflected by an updated “Effective Date” at the top of this document. Continued use of the App after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles.
